This privacy notice will inform you about how we will look after your personal data, your privacy rights and how the law protects you in relation to any data you provide to us in the product user research we are carrying out in relation to our Platform.

This privacy notice supplements our general privacy notice by giving you information about how we collect and process the personal data we obtain from you when you agree to provide user feedback to us as part of our product user research. It’s not intended to override our general privacy notice.

Five AI Limited is the controller of any personal data we collect and is responsible for any use we make of that personal data (referred to as, “we”, “us” or “our” in this privacy notice).

You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (
www.ico.org.uk). We’d appreciate the chance to deal with your concerns before you approach the ICO, so please consider contacting us first.
Personal data, or personal information, means any information about an individual from which that person can be identified.
If you agree to participate in the Product User Research, you will be invited to an interview to be conducted by our internal product team over video conferencing or in person. During the interview, we will ask you questions related to your experience in relation to developing autonomous systems and you will be asked to carry out various tasks using our Platform. The product team will watch how you do these tasks and ask you questions about your experience of the Platform. One member of the product team will conduct the interview, and another will take written notes.
We would also like to video record the session to record your actions for offline analysis by the product team. Before the interview begins, we will check whether or not you are happy for us to video record the session.
The notes, and where relevant the video recording, from the interview, will be kept confidential within Five and only used for the purpose of improving our Platform as follows:
The lawful basis for processing your data is that it’s necessary for our legitimate interests (improving our Platform). While participation in the user feedback is voluntary and we do not collect the product user research data unless you consent (and you are able to withdraw from the research as we explain below), we generally do not rely on “consent” as the legal basis for processing your personal data.
Future research participationWe would also like to keep a record of your name, organisation and contact details so that we might contact you again in future to ask you to participate in future product research. You will be asked at the beginning of the interview whether or not you are happy for us to keep this information for that purpose.
Where you ask us not to retain your data for this purpose, your personal data will not be retained for this purpose. However, please note it is possible we could contact you again if we obtain your details again. Also, this will not affect our retention of any personal data relating to you that we may already hold for other purposes (if you wish to exercise your rights in relation to that data please contact us - see
https://five.ai/privacy for further information about what your rights are and how to exercise them).
Your personal data will be kept confidential within Five.
We will need to share the information we collect with our trusted service providers (acting as processors on our behalf) who provide IT and system administration services for us in order for them to provide their services to us for the purpose of the research.
The information will not be shared otherwise, save in the event we were required to disclose it by law, governmental or regulatory body, or by a court of other authority of competent jurisdiction. In that event, we may also need to share the information with our professional advisors, such as lawyers, to the extent they require such personal data to provide their services to us.
Product User Research DataAny personal data we collected for the Product User Research, will be retained only for as long as we need to retain it to carry out the purposes in paragraph 3. above. As mentioned, the results of the analysis will be anonymised and aggregated with the results of the other interviews by the product team so that you can no longer be identified. The original notes and video recording (save for any excerpts that you’ve given us your permission to use in internal reports) will be destroyed as soon as the relevant analysis is complete, usually no later than 8 weeks after the date of your interview.
In addition, if you change your mind about participating in this research you can contact us at any time to ask us to delete the notes of the interview and any video recording.
Where you give us permission to use an excerpt in an internal report that excerpt will be retained for so long as the internal report is retained, but rest assured that the excerpt will only be used for the purposes of that internal report. Once incorporated into a report it may not be possible to delete that data at your request unless there is a legal requirement to do so, so please do not grant us permission to use an excerpt unless you are comfortable with this.
Future Research ParticipationIf you give us permission to retain your personal data in order to contact you in future about participating in other product user research, we will retain those details for a reasonable period for that purpose unless and until you contact us to withdraw your permission for us to do so. You may contact us to do so using the contact details provided above.
Under certain circumstances, you have rights under data protection laws in relation to your personal data. Please see the section headed ‘Your legal rights’ in our general
privacy notice which explains what those rights are and how you can exercise them.
This privacy notice may be updated from time to time. We will post any changes we may make on this page and when amendments are made, we will update the "last updated" date at the top of this notice.
